Since you were out of the country for more than a year on your previous H1 and subsequently you came to US on a H-4 visa, if you apply for H-1 now, you start afresh. You cannot "transfer" your old H-1 AFAIK, please check with other gurus on this forum.
Also, what this means is since this year's quota is exhausted you probably will have to apply after April 1st and if your H1 is approved, it will have a start date of Oct 1, 2010.

I have an H1, with a receipt date of April 2006. It was valid till July 2008. I came to US on that H1 in 2007 for 2 months. After that I have been working in India till March 2009.

Currently I am on H4. And there is a gap in employment since March 2009.
I have got an offer now and employer will take care of my H1.

I need to know what is the process of H4 to H1 in this case.? Can anybody help me
How much time does this change of status takes place?
The H1 now will be valid for how much time?
Will it depend on my husband's expiry date of H1. My husband's H1 is expiring in Sep 2010
Is it not recommended to move out of the country till status is changed from H4 to H1.

Please somebody reply. Its urgent!

485 receipt notice is required for new EAD or for renewal of existing EAD. Pl send them a copy of the I485 receipt notice document in addition to a copy of the existing EAD card

For my marriage, I applied for her appointment at the consulate on L2. The date was set such that we would have our marriage certificate by then. When she went for the interview, she showed them the marriage certificate, and got the L2 approved.

If she is planning to change her name, then it gets complicated as she can only fix an appointment at the consulate after updating her name, passport, marriage certificate etc etc etc

What type of phone do you have that has that kind of image quality?

Exif data shows:

HTC - MDA_compact_IV .. which is the Tmobile name for the HTC Diamond :P.
It has a 3.2 megapixel camera. I do however believe that it doesnt really matter what camera you use, if you cant make good pictures with a pocket camera then a $2000 camera wont help either ;)

Like many others we have been waiting for our AOS application to be approved for over 2 years. But the strange thing is, I did get an EAD approved but they never called me in for fingerprinting and Biometrics. I know I had to do the non-immigration "registration" that was initiated a few years ago and they had taken my fingerprints and biometrics, is that why they didn't call me in again? since they already have it?

Dear fellow IV members,

I was just referring to my first application for EAD filed by my lawyer (july filer)

For Q#12 - Date of last entry into the US - my lawyer had entered (05/10/2007) - the H1-B approval date in date of last entry in to US - is this because of the new I-94 attached to H1-B approval notice?

But the I-94 in the passport shows my actual physical entry into US after my last visit outside the country - 08/10/2006.

I have not traveled outside the country after renewing my H1-B.

Which date did you guys put - the actual date of physical entry or the I-94 start date after renewal of H1-B?

I have not seen the letter myself, but from the content, it appears to be a specific reply to your letter. I request you to get a couple of friends together and schedule a meeting with the Senators local office. IV website has lots of resources and if you were to let us know once you have the meeting set up, one of us will get in touch with you and brief you on how to conduct the meeting.

If your university is outside of USA, then how about you get a Foreign Credential Evaluation done..This will clearly state, if your educational qualifications are considered equivalent to a Masters in the USA..This will enable you to file your application with confidence...Talk to your lawyer.

If you are a pharmacist then try to speak to big chains like walmart, Rite aid and walgreens. They do H1s for foreign graduates but certain conditions apply like you should have already passed the FPGEE.

i am a pharmacist recently licensed in florida and i found 2003 approved labor but my lawyer is telling me that in order to substitute it for me i must be licensed in florida at the time of filling date of this approved labor which is in 2003.

Hi All,

We need to work towards fixing the USCIS Online Case Status System of Texas Service Center, lot of people are not receiving updates in email/website about their cases.

How will you do that? I guess, while working on cases, user has to click somewhere to send an email. If they choose not to, then there will be no email. In my case, I never saw consistency in getting emails. I don't think that is a big issue, just check your status periodically. Bigger and important issue is how to get your case processed faster, and in sequence.

Actually, that is not true. USCIS is part of US Govt. That is true. But, the department is run exclusively on the funds generated by receipt fees. So, they do have a responsibility towards us. dont you think
