    You can walk-in and get FP done without any problems. I did it 2 weeks before the specified date (at another location) when I went there to the Boston office to accompany another person. Just showed the FP notice (for a different location) and they didn't ask anything.

    Unless the first company cancels their H1B
    they don't need to cancel the H1.As he might have been already working for company B.company A might have stopped running payrol for him..so he is already out of status.

    If the old company not revoked, you can travel with that old I 797.

    If you get an approval from your new employer when u r ome country, better ask your employer to send it to you, so that you will get I-94 with new date on it...

    In port of entry they will ask for your H1 Docs and your work location if it is consulting company or client letter, in some cases may be more docs like W2's...

    I live/work in california - and on the I-485 form it says the address is :
    USCIS Nebraska Service Center
    P.O. Box 87485
    Lincoln, NE 68501-7485

    but it also says in the first few lines in the form:
    If you live in one of these states or territories, please read this notice to determine your filing location:
    ALASKA, CALIFORNIA, IDAHO, IOWA, KANSAS, MARYLAND, MISSOURI, MONTANA, NEBRASKA, NEW MEXICO,OKLAHOMA, OREGON, TEXAS, AND WASHINGTON
    AS PREVIOUSLY PUBLISHED AND REMAINS IN EFFECT - EFFECTIVE DECEMBER 1, 2004DIRECT MAIL INSTRUCTIONS FOR PERSONS FILING FORM I-485

    Also if I use fedex then it cant deliver to the PO Box..I am really confused..

    If its possible to file at a local USCIS center its better because it can reach there faster- maybe even today?

    Can someone please advise? Apologies if this has been covered already.

    Short version: If GC is applied and it is close to 300 days only (and not mandatory 365), is it possible to get further H1B extensions after reaching maximum limit? If so, how?

    I am in a unique situation. Here's my long story.

    I have been on H1B since I landed in USA. My current H1B expires on 04/15/2012.

    That would be close to 12 years on H1B. I know, very long.

    After my first 6 years on H1B, I received further extensions based on my pending Green card application and approved I-140.

    My most recent/current H1B extension was received with a different company, and I would like to stick with this one for a long time. The 3-year extension received in April 2009 was based on previous I-140.

    The problem is, due to certain circumstances which are beyond my control, there is a possibility that the previous GC application and I-140 could be revoked. And this revocation could happen very soon.

    Considering that I can get my further H1B extensions only with my current company's new green card application, I have very limited time now. Assuming the process gets completed only in the next 60-90 days, I will have only 300 days before my H1B expires.

    I understand that to get H1B extension after maximum limit of 6 years ( in my case longer), the applied GC application should be older than 365 days.

    Is there a legal way to extend my H1B next year under these circumstances? If so how?

    I think if one is in hell, USCIS can hand deliver..

    Heaven is another Story (storey?).. :-)

    But as a recent believer in buddhist ideals, I think I will just be a cow in my next life..

    That brings up a good point.. as a cow, it would be a bad life for me in USA.. India would be much better bet.. I would be worshipped and rarely eaten.. hmm.. Thinking ahead of the curve, I think I will apply for a "cow green card" for India.. Cows will be clamouring to get to India.. I will be mooing away soon..

    I have done this successfully twice (extended) , but you do have to fill out that column. Its a big risk to give incorrect info, since they will find out with A#.

    I have sent the request for renewal of my and my wife's advance parole to the USCIS about 10 days back.
    Following is the list of documents that I have sent, along with a fees of $360, online (each)
    - Copy of the Confirmation Receipt notice.
    - Copy of I-485 petition.
    - Current Status of I-485: Case received and pending.
    - Copy of I-94.
    - Copy of current approved I-512L, authorization for Parole of an Alien Into the United States.
    - Copy of Passport.
    - Two photographs.
    - Copy of Drivers License.
    Do I need to send any fingerprinting document?
    Is there anything else that I need to take care of related to this request for advance parole renewal?
    I really appreciate your help in the matter. I got the receipt from USCIS.

    I sent my EAD copy as well.

    It's hard to answer your question without more details, such as your current status. Company B can definitely file a new H-1B for you. Your current status will dictate whether you "need" to tell them about the earlier filing. However, having a prior petition filed might not have any negative impact, so you probably don't need to be nervous about telling Co. B.

    Can anyone please share info on conversion of EB3 to EB2 after applying for 485 ?. Our lawyer now suggests that they cant apply for EB2 and they have to revoke EB3 application.. Is this applicable to even apply for EB2 labor and subsequent I140. I thought we need to revoke 485 only when we are about to apply for new 485. Also, please let me know if we can apply for EB2 when you are in EAD status and has not invoked AC21. Sorry, if this question was already answered in the forum.

    There is hope, but is it possible?

    "Finally, there is another stop-gap proposalthat would �reclaim� 300,000 unused H-1B visa numbers as well as 250,000 wasted employment based
    immigrant visa numbers and make them available in a floating pool as temporary relief. There has been a great deal of speculation that the House leadership may take the SAVE act and bring it to the floor before enough signatures can be collected to force a vote. The idea is that they would add some or all of these other proposals, or even amnesty itself, to the SAVE act to make it unattractive to the original sponsors�thus killing it.

    It is doubtful that anything other than amnesty would kill this legislation.
    There is a serious risk for the Democrats in forcing their members to vote
    down an amnesty bill. That would undoubtedly alienate one of their core
    voter constituencies.

    If the SAVE bill passes, the likely result is that support for legal immigration reform will increase substantially. A number of members of Congress have said that they support legal immigration reform, but first want to see new enforcement measures put into place"

    hi, first, I'm not trolling. I have a genuine question and I'm looking for answers seriously. I got laid off in 2009 while on a h1b and then for one reason or another, stayed back for 8 months. My understanding was that I could have gotten a new job within 6 months and then switched over my h1b. I was foolish. My I-94 on the h1b approval letter however had an expiration date of October 2011. By the time 8 months had gone by, I decided it was time to give up hope and return to my country.

    Since I've been here, my parents have started a campaign to get me a bride. Arranged marriages are part of my culture, and people marry based on how good a match it is according to one's birthchart. If I do find a USC who is willng too marry me, will it help me in any way immigration wise? Or will my 8 months out of status stay in USA chase me for the rest of my life?

    Thanks for the reply.

    Ok, here is the situation. I am the guy in this venture with all the business contacts and would have to involve in some email conversations with the clients and also visit them on an occasional basis.

    I am willing to do this without pay and also appoint someone as CEO instead of me. Can I be the Chairman of the Board, and do this kind of work.
