Absolutely, she can go for stamping in India with your H1B approval and get it stamped. If she were in US, based on your H1B approval she will get an Dependent approval notice and a new I-94, she still needs H4 visa to travel.
If you file for H1B renewal in regular process it might take more time, so if you are in a hurry then go for Premium.

Yes I declared my arrest in I485 and have got my EAD and AP aproved.
Did anyone in this situation travel on AP?

I am kind of in the same situation...But, I don't know if the status means what it says.
But, I got the status change in Jul 2008 saying that
'the post office returned the notice we last sent you on this case I-485 application to register permanent residence or to adjust status as undeliverable. This may have serious effects on processing this case....'
The very next day I got this case status change saying that..
'We mailed document to the address we have on file, You should receive the new document within 30 days.....'
I took an InfoPass appointment and explained to them the case status emails. I also told them that I didn't get my biometrics notice. They asked me if priority date is current..I said NO and they verified too. So, they took the "document mailed" as the biometrics notice document and took my biometrics. I never bothered about that since then....
But, with new system change it shows as 'Document Processing & Oath ceremony'. So I am not sure what the original case status changes emails were about...and take the status 'Document processing and Oath ceremony' seriously.

Hi Folks,
It is crunch time! I have 15 days left to get an H1B 3 yr. extension (since PD is current EB3 India, my H1 expires July 30th), so I need to decide whether I should file I-140 in Premium Processing.
How much time has it taken for members to get 140 approved though PP? I value your feedback, or pls. point me to a poll/data elsewhere!

I got mine approved exactly in 3 days. It took 2 weeks actually a copy of the approval notice after that.

The status changed to "Request for RFE" on Feb 09. Got the RFE with 11 questions yesterday. The questions asked were more about my specialty, my company and the clients contract, other fellow aliens from my company working for the client's status and profiles. So now not sure what my company will do with the RFE.
My questions are -
1. If my company withdraws the L1 Extension petition, then how many more days I will be able to stay in US legally.
2. My wife is currently 22+ weeks pregnant, will US Govt consider anything for her medical situation?
3. Whats the possibility that VSC will accept the extension if we send the answers to the RFE?
4. If the petition is denied, then how many more days I will be able to stay legally?
I would appreciate if anybody can answer my questions.

I doubt it, as the only issue I am aware of is some concerns about noise, and that doesn't seem big enough to do a recall

As per Section 201 of the Immigration and Nationality Act, out of 114,200 visas for 2nd Preference, 89,000 reserved visa numbers has been allocated to F2A and the rest something around 26,600 visas has been reserved to allocate to F2B. But now, in previous year F2A jumps over 4 years� gap and only then they could achieved their quota and who knows there could be a probability of wastage or unused numbers as well. Anyways it will be an advantage for F2B�s because in 2011 they have 89,000 stock again to complete the required given numbers and any body in a world can guess right now after seeing the result of 2010 that it will become current soon. All I wanna say that there could be a tremendous amount of unused visas will gonna distributed among the preceding categories in which they will distribute those unused numbers to preceding categories. Where the maximum will be allocated to F2Bs and rest two: F3 and F4 could also enjoy this unused numbers in a discrete sequence. This process is known as �Spillover�, I have mentioned below the link of USCIS Blog site(Beacon)u guys can go and check it out.

Hi All,
I am here in US on a H1B and my wife is on a H4. She recently got admission to a graduate school and has to start next week. I am worried that if I get her COS for the next semester (this is a 1 year program), then woud she be eligible to get her OPT at the end of the program? She would have been on a F1 for less than a year, but would have completed the Master's program.
I tried to get more information, but what I saw was that the OPT eligiblility requirement is atleast 1 full academic year on F1. Is this correct?
Help is greatly appreciated.

I have been on h1 for 7 yrs in the US and i am leaving back to my home country (India) as it is expiring this month. I plan to come back and start working for my current company next yr.
Now can they Process my new H1 in April next yr(6 months from now) or they have to wait till OCT 2007 to process my new h1. I am afraid the next yr quota will be over if they have to wait till OCT.

In delhi consulate when I click on Indian resident I see the available dates but when I click on Indian citizen residing in US, I see no availability. I'm not sure which option should I choose. I'm a student working on OPT in US. My OPT will expire on Aug 4th and so I will come to India. I'm not sure which of the two options I have to choose while scheduling an interview :

I guess I wasn't shocked when I saw this story, but I have to say it depressed me. The AP reports that Derby Line, Vermont and Stanstead, Quebec, really one town that happens to straddle a border, is now installing security gates to physically separate the community.

Nothing wrong with gates and fences. It's security measure, ... I am all for it and fine. Unlike Quebec, atleast in my America, outsiders are not frowned upon. Nor denied help just becaue you cannot speak their language (French). Take away from my last trip to Quebec (Quebec City) is, they don't like to see us in their part of world, nor do we welcome them.

Yes, go ahead and upgrade your pending H1 extension to premium processing. As per the law, USCIS can deny your H1 extension if a 485 is pending at the time a decision is taken on the H1 extension petition...This is a possibility only if they check if a 485 is pending while they adjudicate your extension petition.....

I did get an LUD on my approved I-140 which i am not using for Adjustment of status. I have applied I-140 and I-485 concurrently through a different employer. I am really surprised what caused to trigger LUD on that I-140. I am not asking for priority date port either. Interesting.....

Has anyone in Charlotte, NC got a extension on the Driver's license on the basis on the H1-B renewal application receipt.
My spouse's driver's license expires this month end. I have applied for h1-b/h4 renewal, yet to receive the application receipt.But wanted to know if anyone here in Charlotte,NC got a extension/grace (30days or 90days) on the basis of the receipt.

I work in a private firm (<300 employees) and they have filed for PERM and is under audit. What would happen to my PERM if a bigger firm takes over my smaller company.
My H1-B 6 yr limit will expire by January 2010. What are the risks to my immigration status if my company is acquired by a bigger firm?
1. Will I have to re-file for PERM again with the new company?

2. Can I continue under the already audited PERM in smaller company's name?

Two little-known types of immigrant visas are the T and the U visas. The T visa is for people innocently involved in human trafficking, and the U visa is for victims of crime. The U visa's basic purpose is to make it easier for police to prosecute those who commit violence.

I will be remoting in from a different state. My employer would not file a new labor condition application which is required.
If the employer is the same and working remotely is an option, then why move from H1B to EAD. Why not keep the current status (full time) and work remote?
