hi all
im in F2B ( LPR filing for son over 21 )
my PD : 12-aug-2009
ON 23-dec-2009 case has been approved , based on the Visa Bulletin currently the are processing visas for F2A with priority date before 1- JUN i think soon " within 2 month " it will become current and thus all unused visa numbers will transfer to F2B ( spilover ) if this happen i assume i will get my paper and interiview within 2011 .
AM I RIGHT ?????
any insight will be appreciated

Thanks for your reply. Nah,I didn't because I have read some where that post office doesn't forwarded the mails related to USCIS so I informed the tenants about the mail.

Yes you can transfer based on the receipt number. There is not restriction on how many H1B petition can be filed on your behalf by different employers simultaneously. As long as you have no GAP in your paystubs during this transition you should be OK. I have gone through this experience in the past without any issue.

Hi Guys

I have a few questions about what happens AFTER the I-485 is successfully filed?


How long before you get the notice to appear for finger printing?
How much time between getting the notice for Finger printing and the actual appointment?
When does the EAD come through and is there a way to expedite the EAD process?
When does the process go to the "name check" black hole and you informed about it?


Any other info by the experienced gurus will be appreciated

Suppose the 485 is filed for a position (salary 70K). When using AC21, does the salary in the new company matters? Suppose if its 110K?


Also, does the title matter? Do we need to get the exact job title in the new company?

It may be one the criteria to check if the new job is same or similar.

Hi,

I recently went through same situation for my spouse on H4. You have 3 options:

1. Call the CBP office where you got I-94 or local CBP office (You can find in Internet, mostly in International Airports) and request them to update thhe I -94. Which may or may not be possible technically. But you may try calling them and schedule an appointment and try this option.

2. Go out of country and come back.

3. File a I539 form to extend non immigrant status. Your employer should help you file it or you may file yourself. It should go to same USCIS service center or office which approved your H1 or H4.

Co. B can file the PERM at any time, but ideally one year before the current H-1B expires, even if that is 8+ years into your H-1B status. Provided that you have a PERM on file 365 days before the end of your H-1B status, the company can extend again based on that PERM #2. The filing does not have to be before the end of your 6th year.

You can start LLC or 'C' corp on EAD. No consequences. You cannot start 'S' corp on EAD. See this:

3.) Depends on your state of registration. Contact Department of State in your state of residence. In Texas you have to pay $750/yr even if you are not doing any business in LLC.

I agree with greyhair.Though you can start LLC, you should still be able to pay taxes as for S corp. Contact you accountant.He will explain to you better.Good luck.

Hello

My wife went for H4 interview on 1/11 and she was asked 3-4 basic questions and her passport and original I-539 was taken. There was no other communication give to her and/or any colored slip given to her.

She has AP and 485 filed but AP didn't come through and she has receipt for both, but VO at delhi didn't look at them.

Its been over 6 business days and no information of passport yet.

We called up consulate and they say its still in processing.

I have read in prior forums with "PIMS", is this delay because of it?

Did someone else had similar experience at Delhi and how long did it took for the passport to arrive.

Sort of quite worried seeing others post that its taking 4-5 weeks for some, but H4 it really shouldn't be that much....

how does ur friend work though???
does he have a valid visa like a Green Card or something...
coz am sure u couldn't have gotten him a H1 visa as u urself are on H1

It is August now and I have almost completed 3 years of my H1 (with a consulting firm) and I am due for my renewal by end of September this year. I have all paychecks proper so far. At this time, I badly want to go back to H4 for a short break while I keep looking for full time positions in the market. Due to recession and my location constraints, I am expecting an offer only after a few months from now. So, is it possible to get a change of status to renewed H1 immediately after I get an offer? How long will this processing take? Will a potential new employer be hesitant to offer a position because of this? My current employer is not willing to sponsor for my renewal. What is the cost of H1B renewal under normal circumstances?
